Carlos Ghosn could win bail as court quashes bid to extend detention

Media reports say Japan has rearrested Nissan Motor Co’s ousted chairman Carlos Ghosn for aggravated breach of trust

The arrest warrant was related to suspicions that Ghosn had covered up private investment losses of around 1.85 billion yen ($16 million) with payments made in 2009 from the Nissan funds, the Kyodo news agency reported.

A Tokyo district court on Thursday refused the prosecutors' attempts to hold him for longer, raising the prospect that he could be freed on bail.

The Nissan spokesman said the company can't comment on "the sequence of events leading to Kelly's detention by the Prosecutors Office, who acted at their discretion".

Ghosn along with former Nissan representative director Greg Kelly were arrested on November 19 on charges of violating the Financial Instruments and Exchange Act for allegedly underreporting the former chairman's JPY 10 billion salary by almost JPY 5 billion over a five-year period until March 2015. Japanese police and prosecutors routinely add new allegations to lengthen a defendant's time behind bars, since each allegation may add up to 20 days.

"This might become a turning point that changes the impression of the special investigation department as being nearly sacred", said Yoji Ochiai, a former prosecutor who now works as a lawyer.

Ghosn, 64, was sent by Renault in 1999 to turn around Nissan, then on the verge of bankruptcy, and he led its rise to become the world's second-largest automaker. The charge carries a maximum prison sentence of 10 years.

On Monday, Nissan failed to agree a replacement as chairman amid growing tensions with the French firm.

Prosecutors were stunned by the Tokyo District Court's rejection of their request to extend the detention of Carlos Ghosn, with some suggesting the court caved in to global criticism of Japan's judicial system.

In addition to charges against Ghosn and Kelly, prosecutors have also indicted Nissan, as the company submitted the official documents that allegedly under-reported his income.

So far, the new allegation only applies to Ghosn and Kelly could still be bailed out. "Greg and Mr. Ghosn fully believe they did not break the law". The French company has asked for such a meeting and would need one to appoint a new board member at Nissan to replace Ghosn.

The scandal has shaken the Nissan-Mitsubishi-Renault alliance, with Nissan CEO Hiroto Saikawa calling for changes to weaken the clout of Renault SA, which owns a controlling stake in Nissan. Lawyers for both men were not immediately available for comment. That had raised the prospect that his lawyers may be able to seek bail and get him out of prison to wait for his trial.

He was seen as the glue holding together the fractious alliance and his arrest has exposed major rifts between Nissan - which makes the most money - and Renault, the dominant shareholder. While there, he had a one-on-one meeting with Renault interim chief Thierry Bollore that Saikawa described as "positive" and "productive", according to Nissan.

Kelly's wife, Donna Kelly, said in a video message carried by TV Asahi and other networks that her husband was "wrongly accused as part of a power grab" at Nissan.
