Trump Administration Moves to Exclude Transgender People from Civil Rights Protections

Transgender activists are up in arms over reports that the Trump administration is considering a policy which would require government agencies to define a person's sex based exclusively on biological considerations.

The Trump administration is considering reshaping some federal policies to define gender according to a person's biology and genitalia, according to a new memo from the Department of Health and Human Services. Almost a third - 32% - of Americans believe transgender people have mental illnesses, according to a report published in January of 2018. It goes on to state, "the sex listed on a person's birth certificate, as originally issued, shall constitute definitive proof of a person's sex unless rebutted by reliable genetic evidence".

The New York Times obtained a leaked memo draft that detailed plans which could put the legal protections and federal recognition of 1.4 million Americans identifying as transgender at risk.

Activists who oppose transgender rights pointed out that even if Trump changes federal rules, MA has state laws banning discrimination against transgender people in employment, housing, and education.

And if other major federal agencies adopt the definition, it could be harder for the advocates to fight it in court.

Through key victories like Whitaker v. Kenosha Unified School District and Macy v. Holder, courts and government agencies have made clear that transgender and gender nonconforming people are protected from discrimination under federal civil rights laws and the U.S. Constitution.

Roger Severino, director of the Office for Civil Rights at the department, declined to answer detailed questions about the memo.

Governor Charlie Baker, a Republican, said if the Trump administration were to eliminate recognition of transgender people in federal civil rights law, he would "obviously" oppose it and reach out to other stakeholders "to build a case for why that's a bad idea". "The court order remains in full force and effect today and HHS is bound by it as we continue to review the issue". Defining sex as "unchangeable" could also imply that a person's gender expression should match their sex that was assigned upon birth.

"We urge the administration to ensure all public health policy is firmly rooted in science, and to keep discrimination and political interference out of our nation's health", added Dr. Lisa Hollier, president of the American College of Obstetricians and Gynecologists.

R. Albert Mohler Jr., president of Southern Baptist Theological Seminary, said defining sex based on self-perception is "unworkable" for society, and at least some negative reactions to the Trump administration's proposal have been unreasonable.

Yet even after that, she continued to stand by her decision to give him her vote, and later that year was even seen wearing a MAGA hat just one week after lashing out at Trump over his proposed transgender military ban.
